Microsoft Sued Over Scratched Xbox Discs

Apparently, Microsoft’s extension of the Xbox 360’s warranty has opened all sorts of doors to further scrutinize the console. One man who claims the Xbox 360 scratched his game discs is chasing Microsoft for $5 million, and calling for a class-action lawsuit against the company.

Jorge Brouwer filed his suit in a Florida federal court on Monday, alleging that the consoles are “negligently designed and manufactured,” according to the International Herald Tribune. Brouwer claims that his Gears of War and Madden NFL 07 discs were both scratched by the unit, but Microsoft still wanted $20 apiece to replace them.

Microsoft denied that the Xbox 360 could scratch discs. “Out of the millions of Xbox consoles in use, Microsoft has not received any widespread reports of Xbox 360s scratching discs,” said Jack Evans, Microsoft spokesperson, in a statement.

The best support for Brouwer’s case may come from a Dutch TV show that supposedly documented the damage a 360 can do to discs. Brouwer’s lawyer, Jeffrey Ostrow, found the reference on Wikipedia.
